Valid regulation on the rights of passengers in road transport

Since 1 March 2013, the following is applied: Regulation No. 181/2011 of the European Parliament and the Council of 16 February 2011 on the rights of passengers in bus and coach transport and the amendment of Regulation (ЕC) No. 2006/2004.
In this regard, you should know the following:
1. The regulation is applied for passenger transport with route length 250 km or more.
Only part of regulation provisions are applied for transport with route length less than 250 km. These are the provisions on the rights of passengers with disabilities or with reduced mobility as well as the provisions requiring bus station owners and carriers to train staff and drivers appointed by them and to render adequate assistance to persons with disabilities or with reduced mobility.
Also, the provisions on the rules for giving information to passengers and submission of complaints must be applied for transport at distances shorter than 250 km.
2. The regulation sets forth the rules on:
а) protection of passenger rights in case of accidents causing death or physical injury to passengers, loss or damage of luggage;
b) prevention of discrimination and compulsory help to persons with disabilities or reduced mobility;
c) protection of passenger rights in case of cancellation or delay of transport;
d) obligation for provision of information to passengers and review of complaints.
3. Art. 42 and art. 45, par. 4 of the Road Transport Act stipulate the maximum compensation due from carrier to passengers travelling in the bus when an accident results in physical injury or death of passengers, loss or damage of luggage. I.e. when an accident during bus travel causes to a passenger travelling by the bus physical injury or death the compensation due by the carrier to the passenger or his relatives may not be more than 220 000 EUR. The maximum amount of compensation due by the carrier to the passenger when after an accident during travel the latter’s luggage is lost or damaged may not be more than 1200 EUR.
To receive the compensations set forth in article 7 of the regulation, the following conditions must be met simultaneously:
а) route length must be 250 or more km
and
b) physical injury, death, loss or damage of luggage must be caused by an accident with the bus.
In case that the regulation does not apply, the compensation due from carrier to passengers for lost or damaged luggage shall be up to 1000 BGN. This amount of compensation is also the maximum one and is stipulated in art.45, par. 3 of the Road Transport Act.
4. In compliance with the regulation requirement that each member state of the European Union must list the bus stations where help will be provided to persons with disabilities or with reduced mobility, this shall be performed with a regulation of the Minister of Transport, Information Technology and Communications. The regulation shall list all operating bus stations on the territory of the country where help shall be provided to persons with disabilities or persons with reduced mobility.
